• Outputs: generated images and your generation history
• Billing data: subscription status and transaction IDs via Polar (we do not store full card details)
• Basic technical and log data for security and abuse prevention (e.g., IP address, device info, timestamps)
• We do not intentionally collect special-category or confidential data; please avoid submitting it

3. Purposes and Legal Bases

We process your data for the purposes below, under the following legal bases:

• Provide the Service, generate images, and deliver downloads (performance of contract)
• Account management, billing, and customer support (performance of contract)
• Security, fraud prevention, and service reliability (legitimate interests)
• Transactional emails (performance of contract) and marketing/newsletter (consent; you can opt out anytime)
• Legal and tax compliance (legal obligation)
• Service improvement using aggregated/anonymized data; we do not use your prompts or images to train third-party models without explicit permission
• No automated decisions with legal or significant effects are made about you

4. Data Sharing and International Transfers

We do not sell personal data. We share only what is necessary with trusted providers. Some providers are located outside the EEA; where required, we use Standard Contractual Clauses or other lawful safeguards.

• Payments: Polar (merchant of record)
• Storage and hosting: UploadThing and Vercel

5. Data Retention

We keep your account data while your account is active. Inputs and generated images remain in your history until you delete them or close your account. Backup copies may persist for a limited period. Billing data is retained for the period required by Spanish tax law (typically 4 years).

We use standard security measures such as encryption in transit (HTTPS) and at rest, access controls, and monitoring. No system is 100% secure, so we cannot guarantee absolute security.

7. Your Rights

If you are in the EEA, you have rights over your personal data, including:

• Objection to processing based on legitimate interests

Terms and Conditions of Use - Visual Post AI

Visual Post AI is an AI image generation SaaS operated by 12builds (Spain). These Terms and Conditions of Use govern your access to and use of the service.

1. Introduction and Acceptance

By creating an account or using the service, you agree to these Terms without reservation. If you do not agree with any part, you must not use the service. Your use is also subject to our Privacy Policy.

2. Description of the Service

The service allows users to submit text prompts or LinkedIn post content to generate AI-optimized images.

3. Accounts and Registration

You must register to use the service. You are responsible for keeping your password confidential and for all activity under your account. The service is available to professionals, businesses, and consumers; by registering you confirm you are at least 18 years old and will use the service lawfully.

4. Pricing, Credits, and Payments

The service operates with credits (1 credit = 1 successfully generated image). Plans: Free plan $0/month includes 4 monthly credits and images may include a subtle watermark; Starter $7/month (+VAT) includes 20 credits/month; Pro $20/month (+VAT) includes 60 credits/month. Unused subscription credits roll over while the subscription remains active. We also offer pay-as-you-go packs (10, 35, or 100 credits) without a recurring subscription. All credits expire 12 months after assignment or purchase. A credit is only deducted when an image is successfully generated; re-downloads are free. Payments are processed by our Merchant of Record, Polar, who calculates and collects applicable taxes. Subscriptions auto-renew for the same term unless canceled before renewal; failed payments may result in retries and temporary suspension until resolved. Accounts inactive for 12 consecutive months may lose unused credits after at least 30 days' notice.

5. Cancellation, Refunds, and Right of Withdrawal

You may cancel at any time from your user panel; access and credits remain available until the end of the current billing cycle, subject to credit expiry. Because a free plan is available, we do not provide refunds for paid subscription periods or credit packs, except for technical failures attributable to us that prevent use of the service. If you are an EU consumer, you have a 14-day withdrawal right; however, by starting the digital service immediately you expressly consent to lose that right once performance begins.

6. Intellectual Property

Intellectual property is handled as follows:

• You keep all rights to your inputs; you grant us a worldwide, royalty-free license to process them solely to provide the service.
• Generated images are assigned to you for commercial use, with no required attribution (though appreciated).
• AI-generated images may not be copyrightable in all jurisdictions.
• The Visual Post AI platform, software, design, trademarks, and documentation remain our property.

7. Acceptable Use and Restrictions

You agree not to use the service to:

• Generate illegal, pornographic, violent, hateful, or rights-infringing content
• Attempt to reverse engineer the software or access the API without permission
• Impersonate others or violate third-party privacy
• Use the service in an abusive, fraudulent, or unlawful manner

8. Availability and Third-Party Providers

The service may be interrupted for maintenance, improvements, or incidents. We will try to provide notice when possible, but availability is not guaranteed. We rely on third-party providers (for example, AI models, cloud infrastructure, or payment processors) and are not responsible for their failures, without prejudice to any legal obligations.

9. AI Disclaimer and Warranty Exclusions

The service is provided "as is" without warranties of any kind. AI systems can produce errors, unexpected results, or images that do not match your intent. Similar images may be generated by other users using similar prompts.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim related to the service is limited to the amount paid by you in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, special, incidental, punitive, or consequential damages, loss of profits, or loss of data. Nothing limits liability that cannot legally be excluded.

11. Indemnification

You agree to indemnify and hold Visual Post AI harmless from third-party claims arising from your prompts, generated content, use of the images, or violation of these Terms or the law.

12. Modifications

We may update these Terms or pricing at any time. We will notify you of material changes by email or in-product notice. Continued use after notice constitutes acceptance.

13. Termination

We may suspend or terminate the service if you breach these Terms, if we detect fraudulent or illegal use, or if required by law. Upon termination for breach, unused credits are forfeited. Clauses on intellectual property, limitation of liability, indemnification, and governing law survive termination.

15. Assignment

We may assign these Terms and our rights or obligations to a third party in the event of a restructuring, merger, or sale. You may not assign your account or these Terms without our prior consent.

17. Entire Agreement

These Terms, together with the Privacy Policy and any documents incorporated by reference, constitute the entire agreement between the parties.

18. Governing Law

These Terms are governed by Spanish law. Disputes will be resolved in the courts of the provider's domicile (Spain), unless mandatory consumer law requires another jurisdiction.

Visual Post AI is an independent service and is not affiliated with, endorsed by, sponsored by, or in any way officially connected with LinkedIn Corporation or Microsoft Corporation.
